Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of the Lets.Tech Portal (the "Service") operated by Lets.Tech ("we", "us"). The Service is provided to business customers ("Clients", "you") under a separate commercial agreement ("Master Agreement"). We provision a Client account for you; you log in to upload, view and manage the personal data of the individuals whose vehicles are captured by ANPR or who are otherwise recorded in your vehicle list ("End Users").

By logging in, setting a password, or otherwise accessing or using the Service, you confirm that you have read, understood and agree to be bound by these Terms, by our Privacy Policy and by our Cookie Notice. If you do not agree, you must not use the Service.

2. Your account

  • We create your Client account on your request. Additional accounts for individuals within your organisation are also provisioned by us at your request, and all such accounts are treated as Client accounts under these Terms.
  • You must keep your credentials confidential and must not share them. You are responsible for all activity carried out under your account, including activity carried out by any individual you allow to use your credentials.
  • You must notify us promptly of any suspected unauthorised access to your account.
  • We may suspend or terminate an account where required to preserve the security or integrity of the Service or to comply with law.

3. Permitted use

You may use the Service only:

  • for the legitimate business purposes for which the Service was provided to you;
  • in accordance with applicable law and your own internal policies;
  • within the scope of the role and site permissions granted to your account.

4. Prohibited use

You must not:

  • access, attempt to access, or use any data outside the scope of your authorised role or site(s);
  • upload, view or otherwise process personal data for any purpose other than as lawfully permitted;
  • introduce malicious code, attempt to bypass access controls, or probe, scan or test the vulnerability of the Service except as expressly authorised in writing;
  • reverse engineer, decompile or otherwise attempt to derive source code from the Service except to the extent permitted by law;
  • use the Service to harass, surveil or unlawfully monitor any individual;
  • extract, scrape, copy or republish data from the Service for unrelated purposes;
  • use the Service in any manner that is unlawful, defamatory or that infringes the rights of any person.

5. Your responsibilities as Data Controller

All personal data uploaded to, captured by, or generated through the Service in connection with your operation of vehicle access and ANPR activities ("End User Data") is processed by us solely as Data Processor on your documented instructions under Article 28 UK GDPR. You are the Data Controller of End User Data and you warrant that, in respect of all End User Data:

  • you have established a valid lawful basis under Article 6 UK GDPR (and, where applicable, a condition under Article 9);
  • you have provided the information required by Articles 13 and 14 UK GDPR to the relevant End Users;
  • you have obtained any consent required under the UK GDPR, the Data Protection Act 2018, the Privacy and Electronic Communications Regulations 2003 ("PECR") or any other applicable law;
  • you have complied with the Surveillance Camera Code of Practice and any other industry codes applicable to your operations;
  • you will handle data subject requests received from End Users and any related correspondence with the Information Commissioner's Office.

We do not independently verify the lawful basis on which any End User Data has been collected by you and we accept no responsibility for the lawful basis of your processing, for the provision of privacy information to End Users, or for the collection of consent from End Users.

6. Spreadsheet uploads

When you upload End User and vehicle records via spreadsheet you must tick the on-screen confirmation that you, as Data Controller, have a valid lawful basis for the personal data contained in the file. We rely on that confirmation and provide the upload facility solely as Processor.

7. Service availability

We will use reasonable endeavours to make the Service available but do not warrant that it will be uninterrupted, error-free or available at all times. Service levels, where applicable, are set out in the Master Agreement.

8. Intellectual property

All intellectual property rights in the Service (including software, interfaces, documentation, branding and any aggregated, anonymised or statistical data derived from operation of the Service) belong to Lets.Tech or its licensors. No rights are granted to you other than the limited right to use the Service in accordance with these Terms.

9. Confidentiality

You must treat as confidential any non-public information about the Service that you encounter through use of the Service, and must not disclose it except as required by law.

10. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is". We disclaim all implied warranties, including fitness for a particular purpose, satisfactory quality and non-infringement.

ANPR matching is performed by automated optical character recognition and is not guaranteed to be 100% accurate. You are responsible for any operational, enforcement or access decisions taken on the basis of Service output, including any human review required.

11. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or for loss of profits, revenue, data or goodwill arising out of or in connection with your use of the Service. Nothing in these Terms limits liability that cannot lawfully be limited (including for death or personal injury caused by negligence or for fraud).

12. Changes

We may update these Terms from time to time. The "last updated" date above reflects the latest version. Continued use of the Service after a change constitutes acceptance of the updated Terms.
